How We Process Takedown Requests

Upon receipt of a valid and complete DMCA copyright infringement notification, Zoosware will take the following steps:

  • Removal or disabling of access: The allegedly infringing material will be removed or access to it will be disabled promptly.
  • Notification to user: We will inform the user who posted the material about the removal or disabling of access.
  • Provision of counter-notification process: The user will be informed of their right to submit a counter-notification if they believe their content was removed by mistake or misidentification.

Zoosware reserves the right to remove allegedly infringing content without prior notice to the user and at its sole discretion.

Submitting a Counter-Notification

If you are a user and believe that your content has been removed due to mistake or misidentification, you may submit a counter-notification to our DMCA Agent. The counter-notification must include the following information (pursuant to Section 512(g)(3) of the DMCA):

  • A physical or electronic signature: Of the user submitting the counter-notification.
  • Identification of the material removed: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (specific URL).
  • A statement of good faith belief: A statement, under penalty of perjury, that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • User’s name, address, and telephone number: And a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the user’s address is outside of the United States, for any judicial district in which Zoosware may be found, and that the user will accept service of process from the person who provided notification under Section 512(c)(1)(C) of the DMCA or an agent of such person.

Warning Regarding Misrepresentation

Pursuant to Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys’ fees, incurred by Zoosware or the injured party as a result of such misrepresentation.
